These Terms & Conditions ("Terms") govern your use of the Bespoke Bangers website and the purchase of any products or services from Bespoke Bangers ("we", "us", "our").
By placing an order, you agree to be bound by these Terms.
1. Our Service
Bespoke Bangers creates custom, made-to-order songs based on information provided by the customer. Songs are generated using licensed artificial intelligence tools and creative processes. Each song is unique and created specifically for the purchaser.
2. Ordering & Payment
• All prices are listed in AUD unless stated otherwise.
• Full payment is required at the time of purchase.
• Once payment is confirmed, your order enters production.
3. Delivery
Finished songs are delivered digitally by email. Estimated delivery time is 1-2 business days, unless otherwise stated. Delivery times are estimates only and not guaranteed.
4. Made-to-Order & Refund Policy
Because each song is custom made:
• Change of mind refunds are not available once production has begun.
• If we determine that a requested song cannot be produced (see Section 5), we will issue a full refund.
If a technical issue prevents delivery, we will either fux and redeliver the song, or issue a refund at our discretion.
5. Content Guidelines & Right to Refuse
We reserve the absolute right to refuse to create a song if the requested content is, in our opinion:
• Hurtful, harassing, defamatory, or abusive
• Discriminatory or hateful
• Sexually explicit
• Violent or threatening
• Illegal or encouraging illegal activity
• Infringing on third-party rights
If a request is refused, a full refund will be issued.
6. Customer Responsibility for Content
You are solely responsible for the information, names, messages, and instructions you submit.
While we take reasonable steps to avoid producing offensive or inappropriate content, ultimate responsibility rests with the customer.
You agree to indemnify and hold harmless Bespoke Bangers from any claims arising from the content you provide.
7. Al-Generated Content & Licensing
7.1 Use of AI Tools
Songs are created using licensed AI music generation platforms. Bespoke Bangers uses these tools under paid commercial licences that permit the creation and sale of AI-generated output, to the extent allowed by the platform's terms and applicable law.
7.2 Copyright Status
The legal status of copyright ownership for AI-generated works varies by jurisdiction. Accordingly:
• Bespoke Bangers makes no guarantee that copyright automatically vests in any song.
• Songs are provided and sold "as is".
8. Customer Licence to Use the Song
Upon purchase, you are granted a royalty-free, transferable licence to use, share, and distribute the purchased song for personal or commercial purposes, to the extent permitted by the licences under which the song was created. This licence does not grant you exclusive rights unless explicitly stated.
9. Bespoke Bangers' Rights to Use Songs
By purchasing a song, you grant Bespoke Bangers a non-exclusive, perpetual, worldwide licence to use the song (in whole or in part) for:
• Website examples
• Marketing and promotional materials
• Social media
• Portfolio or showcase purposes
No additional compensation is owed for this use.
10. No Guarantee of Exclusivity or Originality
While each song is uniquely generated:
• We do not guarantee that songs will be completely original or free from similarities to other works.
• We do not guarantee exclusivity unless expressly agreed in writing.
11. Limitation of Liability
To the maximum extent permitted by law:
• Bespoke Bangers shall not be liable for any indirect, incidental, consequential, or special damages.
• Our total liability for any claim shall not exceed the amount paid for the song.
12. Third-Party Platforms
We are not responsible for the terms, outages, or changes of third-party platforms used in the creation or delivery of songs.
13. Privacy
Personal information is handled in accordance with our Privacy Policy.
14. Changes to These Terms
We may update these Terms from time to time. The version in effect at the time of purchase applies to your order.
15. Governing Law
These Terms are governed by the laws of Australia, without regard to conflict of law principles.
